# Quintiq ## Privacy Policy ### Mobile App Privacy Statement Quintiq (as defined in the EULA) respects the privacy of individuals who use the App ("End User" or "You"). This document, the "Privacy Policy",explains how we collect, process and store any personal data belonging to You, meaning information about You which is personally identifiable such as Your name, address, telephone number or email address. Such information is referred to throughout this policy as "Personal Information". By downloading or using the App You consent to Quintiq collecting, processing, storing and sharing Personal Information in the ways set out in this Privacy Policy. Any capitalized terms not defined herein, shall have the meaning set forth in the relevant EULA and/or License Agreement. ####1. Information collected The App provided by Quintiq may obtain information from, or access information stored on, End Users' Devices to provide services related to the App. For example, the App may: 1. Access calendar information on an End User's Device to enable the End User to match his schedule with the schedule submitted by the End User on the App; 2. Access the geographic location of an End User's Device to enable the End User to identify the best route for the End User; 3. Collect personal information of the End User related to End Users' use of the App services, information regarding End Users' operation systems, and information regarding End Users' interaction with the App, which Quintiq may use to provide and improve the App services; 4. Provide Quintiq with information such as the actions taken by the End User in the App, along with associated information. ####2. Cookies Quintiq uses cookies and similar technologies: 1. To allow Quintiq to recognize End Users and their Devices; 2. To allow the App to interact with third party platforms; 3. To provide End Users with more customized services; 4. To obtain data which will allow Quintiq to understand how End Users are using the App for purposes of improving user experience. By using the App You consent to Quintiq's use of cookies in accordance with this Privacy Policy. ####3. Analytics tools Quintiq may use analytics tools and other third party technologies to collect non-personal information in the form of various usage and user metrics when using the App. These tools and technologies collect and analyze certain types of information, including cookies, IP addresses, device and software identifiers, referring and exit URLs, onsite behavior and usage information, feature use metrics and statistics, and similar information. ####4. Use of information collected You agree that Quintiq (or a supplier or group company acting on Quintiq's behalf) may use Personal Information for the purposes of: 1. Managing Your account and relationship with Quintiq and improving user experience of the App; 2. Marketing and promotion of our App or related products, for example sending communications (including by e-mail) for these purposes on Quintiq's or a third party's behalf. If You do not want Quintiq to use Personal Information in this way please contact privacy@quintiq.com 3. Creating reports, analyses or similar services for use by Quintiq for the purposes of research or business intelligence; 4. Forwarding your information to fraud prevention agencies and other organizations involved in crime and fraud prevention; and 5. As otherwise expressly set out in this Privacy Policy or as may be required by law. The App may transmit information to and from third party Devices to provide the relevant App services. ####5. Sharing of information collected Quintiq may share information and data (including Personal Information) about its Licensees and End Users with its business partners, including its Affiliates, as is reasonably necessary in connection with the App. Quintiq may additionally disclose Personal Information where Quintiq, in good faith, deems it appropriate or necessary to: 1. Prevent violation of any of the terms of the License Agreement, EULA, or this Privacy Policy; 2. Take precautions against liability; 3. Protect Quintiq's rights, property or safety, including those of a partner, any individual or the general public; 4. Maintain and protect the security and integrity of; 5. Protect Quintiq, the App, sites, services or infrastructure from fraudulent, abusive, or unlawful uses; 6. Investigate and defend against third party claims or allegations; 7. Assist government regulatory agencies; 8. Comply with any legal obligations, or enforce or apply the License Agreement, EULA, or this Privacy Policy; Personal Information may be transferred to, and stored at, a destination outside the European Economic Area. It may also be processed by staff operating outside the EEA who work for Quintiq, its affiliates or its suppliers. Quintiq will take all steps reasonably necessary to ensure that Personal Information is treated with care and in accordance with this Privacy Policy. In the event that there is a sale of assets of Quintiq or a corporate restructuring, or as a result of a change of control of Quintiq or one of its group companies, or in preparation of any of these events, a third party to which Quintiq transfers or sells Quintiq's assets will have the right to continue to use Personal Information collected. ####6. Data retention Quintiq will retain Personal Information for as long as is necessary to fulfilthe purposes for which it was collected or as needed in connection with the App. Quintiq may retain Personal Information after You have stopped using the App if such retention of Personal Information is reasonably necessary to comply with legal obligations, meet regulatory requirements, resolve disputes, prevent fraud or abuse, or enforce the License Agreement, EULA, or this Privacy Policy, as well as other legitimate business purposes. ####7. Miscellaneous Quintiq reserves the right to change this Privacy Statement. If a provision of this Privacy Policy or a part thereof is held to be invalid or unenforceable under any applicable local laws or by a court of law, that provision or part thereof shall be interpreted in a manner consistent with applicable law and reflect as much as possible the original intent and the remainder of this Privacy Policy.
